Ears Up - App-Specific Terms of Service

These App-Specific Terms supplement WagDev LLC's General Terms of Service. By using Ears Up, you agree to both these terms and the General Terms.
1. Service Description
Ears Up is a private, single-user daytime-sleepiness self-check-in app for personal use, developed by WagDev LLC.
1.1 Core Features
- Record quick daytime-sleepiness check-ins and ratings
- Attach short notes to a check-in
- Review your own check-in history and simple trends over time
- Optionally set gentle reminders to check in
Ears Up is intentionally calm and anti-engagement: there are no streaks-to-defend, no leaderboards, and no pressure mechanics.
1.2 Offline by Design
Ears Up stores all of your check-in data locally on your device in an encrypted SQLite database (SQLCipher). There is no account, no server, no cloud sync, and no online registration. Your check-in content never leaves your device. The only network traffic the app generates is for serving banner advertisements through Google AdMob (see Section 4) and anonymous crash and error reporting via Sentry in released production builds (see the Ears Up Privacy Policy Supplement).
1.3 No Premium Tier
Ears Up has a single free tier with no in-app purchases, no subscriptions, no auto-renewing plans, and no premium-gated features. The full feature set is available to every user at no charge. Cost recovery for development is via banner ads (Section 4).
2. Age Requirements
Ears Up is intended for users aged 13 and older. Users under 13 are prohibited from using the app. Users aged 13-17 should have parental permission.
3. License to Use Ears Up
WagDev grants you a personal, non-exclusive, non-transferable, revocable license to use Ears Up on devices you own or control, subject to these terms and the General Terms of Service.
4. Advertising
Ears Up displays banner advertisements through Google AdMob. Use of Ears Up constitutes acceptance of receiving advertisements. Ads are served in a way that keeps your check-in content private: your ratings, notes, and schedule are never shared with AdMob or any advertiser. Details of the data AdMob collects are in:

You may control or revoke ad-related data collection through your device's system privacy settings (see Section 5.2 of the Ears Up Privacy Policy Supplement). The app remains fully functional whether or not you grant ad tracking permission.
5. Not Medical Advice
Ears Up is a general-wellness, self-awareness tool. Please read this section carefully.
5.1 A Self-Awareness Tool, Not a Medical Device
Ears Up helps you notice and reflect on patterns in your own daytime sleepiness. It is not a medical device, not a diagnostic tool, and not a substitute for professional medical advice, diagnosis, or treatment. Ears Up is intended only to support general wellness and self-awareness; it is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition, including hypersomnia, narcolepsy, idiopathic hypersomnia, excessive daytime sleepiness, sleep apnea, or any other sleep or medical disorder.
The check-ins you record are your own subjective, self-reported impressions. The ratings, trends, and "what tends to help" observations Ears Up displays are not clinical measurements and have not been clinically validated. Using Ears Up does not create a doctor-patient or any other professional relationship.
5.2 Do Not Make Medical Decisions Based on Ears Up
Always consult a qualified healthcare professional about excessive daytime sleepiness or any aspect of your health. Do not start, stop, or change any treatment, medication, or medical routine based on anything you record or observe in Ears Up. Never disregard professional medical advice, or delay seeking it, because of something in the app. Your clinician knows your full medical history and can weigh factors Ears Up cannot. If you think you may have a medical emergency, contact emergency services immediately.
5.3 Safety-Critical Activities (Driving and Machinery)
Ears Up is not an alertness test, impairment test, or fitness-to-drive assessment, and must never be used as one. Do not use a check-in rating to decide whether you are safe to drive, operate machinery, or perform any other safety-critical task. Excessive daytime sleepiness can be dangerous in these situations. Follow your clinician's guidance and your local licensing and workplace rules about driving and operating machinery. When in doubt, do not drive or operate machinery.
5.4 Use at Your Own Judgment; No Guarantees
Any observations you draw from Ears Up are informational only, and WagDev makes no guarantee that Ears Up will produce any particular result or benefit. Decisions about your health, sleep, driving, and daily activities remain your own responsibility and should be based on your own judgment and professional guidance.
6. User Content
6.1 Your Check-In Data Belongs to You
Any data you create in Ears Up — check-ins, ratings, notes, and schedules — belongs to you. WagDev does not claim any ownership over your data. We also do not have access to it, because it never leaves your device.
6.2 No Sharing Surface
Ears Up has no social features, no accounts, and no mechanism to share your check-in data with other users. Any content you create in the app is for your own use.
7. Acceptable Use
Ears Up is provided for personal self-check-in use. You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code
- Modify, adapt, or create derivative works of the app
- Circumvent any technical limitations of the app
- Circumvent any technical limitations or attempt to misuse the AdMob integration
- Use Ears Up in a way that could damage, disable, or impair the app
8. Data Loss Risk
Because Ears Up stores data only on your device, your data is your responsibility to back up. Device loss, damage, factory reset, or uninstallation will permanently remove all Ears Up data on that device. Use your device's native backup system (iCloud Backup, Google One Backup) to preserve your data.
WagDev is not liable for any loss of Ears Up data and offers no service-level data-recovery commitment.
9. Updates
WagDev may release updates to Ears Up that change features, add disclosures, or modify the AdMob integration. Continued use of Ears Up after an update constitutes acceptance of these changes. For material changes to these terms, the version of this document will be bumped.
10. Termination
You may stop using Ears Up and uninstall it at any time. Uninstallation removes all local data. WagDev may discontinue Ears Up or remove it from the App Store / Play Store with reasonable notice.
